Agreement Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Golden Rule BBQ & Grill, doing business as Golden Rule BBQ & Grill ("Golden Rule BBQ & Grill", “we”, “us”, or “our”), concerning your access to and use of the goldenrulebbq.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. User Representations

By using the Site, you represent and warrant that:

User Generated Contributions

The Site does not offer users to submit or post content. However, we may provide opportunities for you to create, submit, post, transmit, or distribute materials (“Contributions”). Contributions may be viewable by other users and third-party websites. When you submit Contributions, you represent and warrant that:

Your Contributions do not infringe on third-party rights
You have all rights/permissions needed to share the content
Any identifiable persons have given written consent
Your content is not false or misleading
Your content is not spam or solicitation
Your content is not obscene, abusive, violent, harassing, or illegal
Your content does not exploit minors or violate child protection laws
Your content does not contain discriminatory or offensive comments
Your content does not violate these Terms or applicable law

Violation may result in termination or suspension of your right to use the Site.

Contribution License

You agree that we may access, store, process, and use any information and personal data you provide in accordance with our Privacy Policy.

By submitting suggestions or feedback, you agree we may use and share it for any purpose without compensation.

You retain ownership of your Contributions. We are not liable for statements in your Contributions, and you agree to exonerate us from responsibility.

Submissions

We reserve the right to:

Privacy Policy

By using the Site, you agree to our Privacy Policy. The Site is hosted in the United States. If accessing from another region, you agree your data will be transferred to and processed in the United States. We do not knowingly collect information from children under 13.

Term & Termination

These Terms remain in effect while you use the Site. We reserve the right to deny access, terminate accounts, and remove content at any time, without notice, for any reason. If terminated, you may not create a new account under a different name. We may pursue legal action as appropriate.

Modifications & Interruptions

We may modify or discontinue the Site at any time without notice. We are not liable for interruptions or inability to access the Site.

Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles.

Dispute Resolution

Informal Negotiations: Parties agree to attempt informal negotiation for at least 30 days before arbitration.

Binding Arbitration: If unresolved, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will take place in Jefferson, Alabama, unless otherwise required by AAA rules.

Restrictions: Arbitration is limited to the parties individually and cannot be brought as a class action.

Exceptions: Disputes involving intellectual property, theft, privacy invasion, unauthorized use, or injunctive relief are excluded.

Corrections

We may correct errors, inaccuracies, omissions, pricing, availability, or other information on the Site at any time without prior notice.

Disclaimer

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” YOU AGREE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR ERRORS, INTERRUPTIONS, SECURITY BREACHES, OR DAMAGE CAUSED BY THIRD PARTIES.

Limitations of Liability

IN NO EVENT WILL WE OR OUR EMPLOYEES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US WITHIN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

If any part is unlawful or unenforceable, the remaining provisions remain valid. No joint venture or employment relationship is created.
